Birthers vs Obama

Who are the “Birthers?” According to Urban Dictionary a birther is a conspiracy theorist who believes that President Barack Obama is ineligible for the Presidency of the United States, based on any number of claims related to his place of birth, birth certificate, favorite birthday, or whether or not he has heard the song Africa by Toto. MSNBC political commentator Rachel Maddow defines a "Birther" as: “a specific new breed of American conspiracy theorists who believe that the real problem with Barack Obama being president is that he can't possibly have been born in the United States. He's not eligible to be president. The birth certificate is a fake. He's a foreigner. Once this has been exposed, I guess, he will be run out of the White House and exposed for the alien, communist, Muslim, gay, drug dealer, al Qaeda member that he is.”

Natural-born citizen what does that mean? A person born outside the country to citizen parent(s) may be a natural-born citizen for purposes of United States presidential eligibility (example- John McCain, etc). However, such a person would not be a native-born citizen. John McCain is not a natural-born citizen, his citizenship is statutory, which means it is based on statute as enacted by Congress, not his place of birth. He was born in Panama. A person cannot acquire citizenship at birth retroactively unless it is explicitly stated in the law. The 1937 law that granted John McCain citizenship via his birth in the Panama Canal Zone does not explicitly state this. So that law cannot be used to justify his citizenship at birth . It can be used to justify his US citizenship. As referred by legal research addressed in the New York Times, John McCain is not a natural-born citizen. This is not depended on the argument that laws cannot grant citizenship. The 14th amendment says "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside." In Minor v. Happersett, Chief Justice Waite, when interpreting, on behalf of the court, the very proviso of the fourteenth amendment now in question, said: “The constitution does not, in words, say who shall be natural-born citizens. Resort must be had elsewhere to ascertain that.” He proceeded to refer to the common law as an aid in the creation of this provision. 21 Wall. 167.

The jurisprudence of challenging ‘prima facie’ evidence is the primarily rationale for demanding President Obama’s original August 1961 birth registration information. The Hawaii Department of vital records either has a birth certificate from a licensed birthing facility, or merely a compulsory record of data from undocumented and unconfirmed sources. Lawsuits present by Phil Berg, attorney challenging President Obama’s birth in Hawaii have been dismissed in court of law since 2008. Another lawsuitwas dismissed in 2009 by U.S. District Court. In a November 2008 ABC News Hawaii ran this story, “Obama's Birth Certificate Verified By State.” The Associated Press contributed to the report. Under Hawaiian statute, specifically §338-5, it is compulsory for the Dept. of Health to register a newborn child of a Hawaiian resident, even if no documentation of place and time of birth is presented.

The Key Birther lawyer Phil Berg was disbarred in 2004. He was forced to pay out sanctions for legal malpractice. When an attorney is disbarred, he loses his professional license and is banned from practicing law. In general, disbarment occurs when it is determined that a lawyer is unfit to practice law. Charles Edward Lincoln - #171793 is prohibited from practicing law in California by order of the California Supreme Court. Lincoln is another lawyer representing the birthers. He was disbarred in Florida. In 2000, Lincoln was convicted in Texas on a federal charge of falsely representing his Social Security number, a felony. As a result, he gave up his license to practice in the state. The last key birther Orly Taitz - #223433 was admitted to the California Bar in 2002. She is a graduate of William Howard Taft University, Santa Ana, CA. She’s not listed as a member of the American Bar Association. According to Taft website before 2008 Taft Law School operated as a school within William Howard Taft University. Taft Law School has offered distance learning law programs to qualified students around the world. It is America's oldest nationally accredited distance learning law school. So she became a lawyer online with undergraduate studies from Israel. Orly Taitz is also a dentist. You can get your teeth fixed and a law consultation at one appointment. She operates two dental offices in California.

Orly lied that she escaped from the Soviet Union in 1989 according to encyclopediadramatica.com. That would mean she wasn’t a “native born” or “natural born” citizen. If she “escaped” from the Soviet Union did she enter the United States legally? I couldn’t find a complete bio on Mrs. Taitz. Anyone know? Actually got some updated information about Mrs. Taitz. from wikipedia. Taitz was born to a Jewish family in Chişinău, Moldavian SSR, and emigrated to Israel in 1981. Taitz previously been personally involved in 22 lawsuits in Orange County civil court. Most of the cases involved "accusations of dental and medical malpractice" and breach of contract suits.The adage that "a lawyer who represents himself has a fool for a client" is the product of years of experience by seasoned litigators, the Supreme Court has remarked. Being a lawyer and dentist are very intense professions requiring continuing education to remain current and competent. There are medical doctors, nurses, law enforcement and others who become lawyers. I don’t know of any who can continue to do both well.

If you have never worked for the federal government, then you have no idea the security involved. We’re speaking of federal employees, not contractors or temps. These are a sample of the forms for just one agency: Declaration for Federal Employment, Qualifications and Availability Form C and Occupational Questionnaire, and Questionnaire for Public Trust Positions. These forms do not include a security check, criminal background, graduate education with transcript and FBI check. It would be impossible for President Obama to skip this procedure especially since he was a U.S. Senator. Place of birth is on almost every form to be filled. If necessary the FBI will go to your elementary school. They are not above questioning neighbors you have not seen in 20 years. You can be assured the government paid extra attention to the first Black president.

The President graduated from Harvard Law School, not an online degree. He was not disbarred. Any acts of fraud would be the end of his law, political and person life. A President in the spotlight like no other would make it so easy to be discredited is absurd.

What does President Obama’s birth controversy say for our Homeland Security?  If the entire Justice Department can’t figure out where the President was born, why should we trust them to protect us under normal conditions?  What does the birther say of our justice system? As citizens of the United States we gave an opportunity for a woman who claimed to have escaped from Soviet Union at the time of the “Cold War” the opportunity to challenge the President of the United States. She couldn’t do that in the Soviet Union. Yet there are American citizens willing to give her money and the disbarred lawyers working with her. Is she a ‘mole’ sent to disrupt our way of life, and she’s found willing followers. Is she a spy leftover from the ‘Cold War?’ Are there people willing to believe a Soviet educated in Israel over an American born to a white woman in Hawaii because his father was an African?
